These dismissals have many terms and are not always a
defendant's right. These dismissals are valid if the defendant
appears on or before the required appearance date and meets the terms.
Fees for compliance dismissals are payable immediately by cash, check,
money order, or credit card. If the correction is done within the
allotted time but proof is not brought to the court until after the
appearance date, additional fines may apply.
EXPIRED REGISTRATION OF EXPIRED INSPECTION
If you received a citation
for Expired Motor Vehicle Inspection or Expired Motor Vehicle
Registration that was not expired more than 60 days, or for Failure to
Change Address, you may present proof of correction of the violation and
the citation will be dismissed with a $20.00 Dismissal Fee.
The
Expired Registration proof of renewal must include a 20% penalty paid
to the Department of Motor Vehicles when the registration was renewed.
If the penalty is not paid, the Court cannot dismiss the citation.
The inspection proof of correction must show that the vehicle PASSED the
inspection.
If your Motor Vehicle Inspection or Motor Vehicle Registration was
expired more than 60 days, the Judge will not dismiss the citation.
However, if you present proof of correction within 10 calendar days from
the date of offense, the Judge MAY reduce the amount of the fine.
INSURANCE (FMFR)
AND NO DRIVER'S LICENSE
The above named offenses
may be dismissed by the Judge with no charge if the defendant brings
proof of a valid driver's license as required by law and/or proof of
financial responsibility/insurance coverage as required by State Law.
The defendant must bring the proof to the Municipal Court within the 10
consecutive days after the citation is issued. Proof submitted for
the purpose of dismissal will be verified. Most of these
dismissals may be processed at the court counter without having to go
before the Judge. The Judge cannot dismiss these citations without
verification.
The following offenses also carry a Dismissal
Fee:
Expired Driver's
License: $20 Dismissal Fee; Defendant must present proof of a
renewed Driver's License. Proof of correction is the paper
license, which indicates the date of renewal.
Failure to Display
Driver's License: $10 Dismissal Fee; Defendant must show proof
of valid Driver's License valid at the time of the offense.
Failure to Report
Change of Address or Name on Driver's License: $20 Dismissal
Fee; Defendant must present proof of correction.
