Definition
Non-Conforming
use is the current or existing use of a property that through amendments,
etc. to the codes would no longer be allowed by current ordinances.
These properties commonly have been used prior to the change in the zoning
ordinance, or to the city code. Changes in the zoning ordinance will
normally result in non-conforming uses being established on properties
already in use.
Examples

Auto
wrecking yards are not allowed by current ordinance, however, at the
time wrecking yards went into business, they were allowed to operate,
so they currently operate under a non-conforming use.

Duvall
Construction Company at Third Street and Dewitt has operated at this
site since the 1960's. This is a residential zone, however, at
the time they went into business, they were allowed to operate at this
location. They now fall under the non-conforming use.
